Can I Get Workers’ Comp Benefits If I Have A Pre-Existing Condition?

One of the top questions that we are asked is “does a pre-existing condition prevent me from getting workers’ compensation benefits?” The Pennsylvania Workers’ Compensation Act specifically addresses this situation, and establishes rules that allow those with pre-existing conditions to receive benefits in some, but not all, situations.

In the video below, attorney Matt Wilson discusses the topic in more detail and provides an example of a situation where an employee would be eligible for workers’ comp even if he or she had a pre-existing condition.

Having a pre-existing condition does not automatically disqualify you from receiving workers’ comp benefits. The law regarding this area is very situation-specific, so it is important that you talk to an attorney to find out how your particular condition and medical history may affect your ability to receive workers’ comp payments.
