Workers' Compensation Settlements - Compromise & Release

In 1996 Governor Ridge passed an amendment to the Workers' Compensation Act, known as Act 57. The Compromise and Release provisions of Act 57 now allow injured workers and employers or their insurance carriers to settle cases. This settlement tool not only applies to injured workers that have suffered injuries after June 24, 1996 (the effective date of Act 57), but to anyone that is receiving workers' compensation benefits. Under this new settlement mechanism, injured workers can settle future and past indemnity benefits and may also receive a lump sum of monies for past or future medical benefits. Even if someone had previously "settled" their case for a lump sum (commutation) before Act 57, settling the medical portion of their case is still possible.
